Complaints About Linking, Fair Use, and the threat of DMCA complaints

Here is a typical complaint that is sometimes received by webmasters who have quoted a few sentences from another site: (a few details changed to undeservedly protect the clueless)

For the "scraping" in question, the offending webmaster had used parts of 5 or 6 sentences to go with the directory listing. The funny thing is that 3 of them appear to be things the clueless webmaster borrowed from other reviews, or quotations from the book. In other words, the clueless webmaster complained about a good normal on-topic link to their site from a site who borrowed about as much from them as they borrowed from others.
Their link was of course removed, not because of the threats, but because of not wanting to continue to reward cluelessness. Another more deserving article covering the same ideas was found, and link to it now replaces the link that used to go to the clueless webmaster, and the following link was placed in the directory: http://sitekreator.com/SudsySoapBox/elizabeth_taylor_and_jewelry.html
In an [article on Search Engine Watch entitled Deep Linking Lunacy], Chris Sherman says:
- Deep links are nothing more than a URL and some words describing that URL. In other words: facts. Facts are not copyrightable.
- Sites that prohibit deep linking suffer from malignant stupidity, driven by a fundamental misunderstanding of the web and user needs. The whole point of having a public web site is to encourage users to visit, and deep links make finding and visting sites easy. Home pages, typically offering cluttered design and feeble excuses for site search tools, make finding content much more difficult.
