SPAM (UNSOLICITED BULK EMAIL)
The sending of spam (unsolicited bulk email) is not permitted. If you use the FreeViral (Search for FreeViral).com website in any way to send spam, your membership will be terminated immediately. Further if you send spam by some other method(s) and that transmission is in any way associated with your FreeViral (Search for FreeViral).com membership, or if you use spam to promote your FreeViral (Search for FreeViral).com webpage, your membership will be terminated immediately.
We are the sole judge and have final authority on what is to be considered spam. If you are wanting to do something that you think may even be remotely considered spam, contact us first to determine whether what you want to do is or is not considered spam.
ADULT / PORN / WAREZ / HACKING / ILLEGAL ACTIVITIES / HATE-RELATED SITES
You may not use FreeViral (Search).com to promote any site related to adult content, porn, warez, hacking, illegal activities, hate-related sites, or any other website that is considered offensive to the general public. Doing so will result in immediate termination of your FreeViral (Search).com membership.
MISUSE OF PROMOTION TOOLS & BLASTERS
Misuse and/or abuse of FreeViral (Search).com will result in immediate termination of your FreeViral (Search for FreeViral).com membership.
You may not use FreeViral (Search).com to promote any announcement related to porn, warez, hacking, spam, copyright infringement, theft of service, illegal activities, or hate-related sites.
All usage is tracked by IP number and can be traced to your computer's IP number and your ISP. We work with ISPs and anonymous proxy companies in order to detect abuse and fraud.
PRIVACY STATEMENT
We respect your privacy. Your email address and other info about yourself is confidential and will not be sold or given away. We may, from time to time, send you special offers related to webmaster promotion. You may remove yourself from our list at any time, by clicking on a remove link provided at the bottom of any email message.
TRANSFER OF USER ID / PASSWORD SHARING
Access to the FreeViral (Search).com members area is through a combination of a username and a password (UserId?Create|Search). Members may not under any circumstances release their UserId?Create|Search to any other person, and are required to keep his or her UserId?Create|Search strictly confidential.
eHits will not release passwords for any reason, to anyone other than the FreeViral (Search for FreeViral).com member, except as may be specifically required by law or court order.
Unauthorized access to the FreeViral (Search).com members site is a breach of this Agreement and a violation of law. Subscribers acknowledge that the webmaster of the site may track through the use of special software each subscribers' entry to the site.
If any breach of security, theft or loss of UserId?Create|Search, or unauthorized disclosure of UserId?Create|Search occurs, subscriber must immediately notify eHits of said security breach. Member will remain liable for unauthorized use of service until eHits is notified of the security breach by email or telephone.
PASSWORD SHARING CONSEQUENCES & MISCELLANEOUS
Password sharing is considered theft of services and is illegal. Password sharing can be detected.
Sharing your FreeViral (Search for FreeViral).com password with another person will result in immediate termination of your membership. Further we report all cases to the FBI Computer Crime Division, and we substantiate our reports so the FBI may investigate and prosecute. The FBI Computer Crime Division website states that ALL CASES OF FRAUD & COMPUTER CRIME ARE INVESTIGATED FULLY.
Further anyone who shares their password with another person will be reported to a number of fraud databases. Many online commerce systems check these databases during an electronic transaction.
Further we reserve the right to take legal action and other remedies against anyone who shares their password or commits any other computer crime or theft of services.
AUTHORIZATION OF USE
FreeViral (Search).com members are hear-by authorized a single license to access the FreeViral (Search for FreeViral).com members area, and to use it within the terms of this agreement. This license shall granted for sole use via one computer.
No material within the site may be transferred to any other person or entity, whether commercial or non-commercial.
In addition, materials may not be modified, or altered. Materials may not be displayed publicly, or used for any rental, sale, or display. Materials shall extend to copyright, trademarks, or other proprietary notices therefrom.
eHits reserves the right to terminate this license at any time if the terms of this agreement are breached. In the case that the terms are breached, you will be required to immediately destroy any information or material printed, downloaded or otherwise copied from the FreeViral (Search for FreeViral).com members site.
FINAL AUTHORITY
We are the sole judge and have final authority on what is to be considered spam, and abuse and misuse of the FreeViral (Search).com members site. If you are wanting to do something that you think may even be remotely considered spam or misuse/abuse, contact us first to determine whether what you want to do is acceptable.
LIMITATION OF LIABILITY
We will not be liable for indirect, special or consequential damages, or any loss of revenue, profits or data, arising in connection with this Agreement or your membership or the FreeViral (Search for FreeViral).com website, even if we have been advised of the possibility of such damages.
NO GUARANTEES ON RESULTS
eHits makes no promises or guarantees on how the FreeViral (Search for FreeViral).com members site may affect your website visitor traffic or your financial success.
NO GUARANTEES ON FUNCTIONALITY/UPTIME
While it is our goal to have all areas of the FreeViral (Search for FreeViral).com site fully working during all times, 24 hours a day, 7 days a week, there may from time to time be a webpage, link or tool which is not working. Once we learn of said problem we will attempt to correct the problem in a reasonably quick manner. To date we have had 99.99% uptime, however we make no guarantees on website functionality and uptime.
SUPPLEMENTARY TERMS & CONDITIONS
The FreeViral (Search).com members site may have additional Terms and Conditions that are an integral part of this Agreement, and are in addition to these Terms and Conditions. Such Terms and Conditions as listed at the` FreeViral (Search).com members site will in no way invalidate any of the Terms and Conditions listed here. All Terms listed apply to eHits and the FreeViral (Search).com member.

MODIFICATION
We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion, by posting a change notice or a new agreement on this site or on the FreeViral (Search).com members site. If any modification is unacceptable to you, you have the right to terminate this agreement. Your continued participation as a FreeViral (Search).com member following our posting of a change notice or new agreement on our site will constitute binding acceptance of the change.
TERM OF AGREEMENT
The term of this Agreement will begin upon our acceptance of your online application/order and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party notice of termination either in writing, by email or by telephone or fax. You are only eligible to earn referral fees on sales occurring during the term.
CANCELLATION
At any time, and without cause, membership may be terminated at by either eHits or the FreeViral (Search).com member, as per the terms in the above paragraph.
SEVERABILITY
If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid or enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
INDEPENDENT INVESTIGATION
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE WEB SITES THAT ARE SIMILAR TO OR COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.
MISCELLANEOUS
This Agreement will be governed by the laws of the United States and the State of California, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state courts located in San Diego, California, and you irrevocably consent to the jurisdiction of such courts.
You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of and be enforceable against the parties and their respective successors and assigns.
Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
NOTICE
Notices by eHits to FreeViral (Search for FreeViral).com members may be given by means of electronic messages through the FreeViral (Search for FreeViral).com members site, by a general posting on the FreeViral (Search).com members site, or by conventional mail.
Notices by FreeViral (Search for FreeViral).com members may be given by electronic messages, conventional mail, telephone or fax unless otherwise specified in the Agreement. All questions, complaints, or notices regarding the FreeViral (Search).com members site to eHits must be directed here.
