FREQUENTLY ASKED QUESTIONS
1.How do I submit a FOIA Request? All requests submitted under the FOIA must be in writing, the documentation you are requesting must be properly described, and your request must contain a statement that you are willing to reimburse the government if there are any charges for processing your request. Additional instructions concerning submitting a FOIA request may be found at http://www.foia.af.mil/faq. All requests must be in compliance with these requirements and may be requested by one of the following means:

2.In addition to the per page copying charge, may costs be assessed for the time spent copying responsive documents? No; duplication of records, by definition, includes the time it takes to copy records. OMB Fee Guidelines, 52 Fed.Reg.at 10,018.
3.When may mailing costs be assessed? The ordinary costs of packing and mailing copies of (a)(3) records are borne by the agency. See OMB Fee Guidelines, 52 Fed.Reg.10,016. Any "special services" asked for by the requester and agreed to by the agency my be collected from the requester, for example, the cost of overnight delivery by Federal Express.
4.Why are FOIA fees deposited in the US Treasury? It is required by law, 31 U.S.C. 3302.
5.How are requests categorized for fee purposes when submitted by an attorney? It depends if the attorney is making a request on behalf of another or submitting his own request. Look to the actual requester.
6.If a fee waiver is requested, should it be resolved before anything else? The agency should first determine if there are responsive records and if so, are there assessable fees.
7.Agency X contracts out its FOIA duplication work. How should it assess fees? "Agencies should ensure that the ultimate cost to the requester is no greater thatn it would be if the agency itself has performed [the photocopying]." OMB Fee Guidelines, 52 Fed.Reg. 10,018.
8.When considering the appeal of a commercial use requester, may the agency assess "review" charges? Review charges may only be assessed the first time an agency reviews a record for the application of an exemption. OMB Fee Guidelines, 52 Fed.Reg. 10,015. In certain limited instances, this may occur on appeal. (Example: Material is withheld under Ex. 1 at initial level but is declassified on appeal. The material may be reviewed [and review fees assessed if appropriate] for application of other exs.)
9.Requester Z is in litigation and makes a FOIA request in lieu of a discovery request. May fees be assessed? Yes; fees should be waived only if the request meets the statutory standard.
10.What type of information is not releasable without consent? Personal information and proprietary information.
11. Is UFO Information Still Available From Wright-Patterson AFB? The only "UFO" documentation available from Wright-Patterson AFB pertains to "Project Sign" and "Project Grudge". Requests concerning these documents should be addressed to:
